Malta has implemented the Cookie Directive into its legislative framework, and the matter falls within the regulatory competence of the Information and Data Protection Commissioner. The broad majority of other EU states have similarly implemented the Cookie Directive, with a few exceptions and with some other hybrid systems.
The report was drawn up in recent weeks and briefly sums up the situation across the EU, while shedding light on how individuals or entities operating across EU borders may find themselves affected by a few of the pecularities that exist insofar as the Directive has been implemented.
The study was conducted by Dr Michael Zammit Maempel, the firm’s practitioner on ICT and data privacy law; and the survey was coordinated by Bristows LLP (http://www.bristowscookiejar.com) with whom GVTH collaborates on technology, media and telecommunications matters.
